Certainly. The petition for probate is essentially a formal request to the court to begin the process of administering the deceased person’s estate. It’s a multi-faceted document that outlines key information, including the decedent’s identity, the estimated value of the estate, and the petitioner’s request to be appointed as executor or administrator.

Ordinarily, the petition is filed with the court in the county where the deceased resided. Importantly, it must include a copy of the will, if one exists.

Consequently, accuracy and completeness are paramount when filing this petition. Any omissions or errors can lead to delays and complications down the line.

Moreover, the court will review the petition to ensure all legal requirements are met. If everything is in order, the court will typically issue Letters Testamentary or Letters of Administration authorizing the executor or administrator to proceed with their duties.

In those instances, we had to rely on other evidence, such as witness testimony, to establish the decedent’s testamentary intent.

I recall one case where a family couldn’t locate their father’s will. After diligent searching, we discovered he had kept it in a safe deposit box. We were able to access the box and obtain the will, which ultimately avoided a lengthy and costly intestate succession proceeding.
