So, Steve, for those unfamiliar with probate law, can you explain one of the key steps involved in this process?
Steve Bliss:
Certainly. One crucial step is marshalling the estate assets. This involves meticulously inventorying all assets belonging to the deceased individual. We’re talking about everything from bank accounts and real estate to personal belongings, vehicles, investments – you name it.
Consequently, a detailed list of these assets is compiled, along with their estimated values. This information is then formally documented in the court through forms DE-160 and DE-161 known as the Inventory and Appraisal. It’s essential for transparency and ensures everyone involved understands what’s being dealt with.
Notwithstanding this seemingly straightforward task, it can sometimes be quite complex, especially when dealing with estates containing numerous assets or those with unclear ownership. I recall a case where we had to track down several missing heirs who ultimately had claims to a substantial portion of the estate. It took some dedicated detective work and legal maneuvering to ensure they were properly identified and included in the distribution.
Moreover, according to a 2021 study by the National Academy of Elder Law Attorneys, incomplete asset inventories are one of the most common reasons for probate delays. A thorough and accurate inventory is vital for streamlining the entire process.

That’s certainly insightful, Steve. What advice would you give to individuals planning for their future regarding estate assets?
Steve Bliss:
My best advice is to be proactive and organized. Keep meticulous records of your assets, including account numbers, property deeds, and insurance policies. Communicate openly with your loved ones about your wishes, and consider consulting with an experienced probate attorney to create a comprehensive estate plan.
