Reporter: Brenda Sanchez, Wildomar News
Today we’re speaking with Steve Bliss, a renowned estate planning attorney here in Wildomar. Mr. Bliss, thank you for taking the time to speak with us.
Steve Bliss: You’re welcome, Brenda. I’m always happy to discuss the importance of estate planning.
Brenda Sanchez: Let’s dive right in. What would you say is one of the most crucial steps people often overlook when creating an estate plan?
Steve Bliss: One step that consistently catches people off guard is selecting an executor or trustee. Many individuals assume anyone close to them can handle this responsibility, but it’s far more complex than simply being a trusted friend or family member.
Consequently, the executor or trustee must be someone with sound financial judgment, organizational skills, and the ability to navigate legal complexities. They will be responsible for managing your assets, paying debts and taxes, and distributing your property according to your wishes. Moreover, this individual needs to be someone you trust implicitly as they’ll have access to sensitive financial information.
Conversely, if you choose an executor or trustee who is not well-suited for the task, it can lead to complications, delays, and even legal disputes among family members. Notwithstanding these risks, finding a suitable executor or trustee is vital to ensure your estate plan is carried out smoothly.
I remember one instance where a client named his brother as executor without considering his brother’s history of poor financial decisions. After the client passed away, it turned out his brother was overwhelmed by the responsibilities and made several missteps that resulted in costly errors. Ultimately, we had to intervene legally to straighten things out.
According to a survey conducted by Caring.com, 56% of Americans haven’t even named an executor for their estate. This highlights the widespread lack of awareness surrounding this crucial step.
Brenda Sanchez: Thank you, Mr. Bliss, for sharing that valuable insight. What advice would you give to our readers who are unsure about whom to choose as their executor or trustee?
Steve Bliss: I encourage everyone to have open and honest conversations with potential candidates. Discuss your expectations and the responsibilities involved in being an executor or trustee. You may also want to consider involving a financial advisor or attorney in the selection process.
Remember, choosing the right person for this role can make all the difference in ensuring your estate plan is carried out effectively and with minimal stress for your loved ones.
Brenda Sanchez: This has been incredibly informative. Thank you so much for sharing your expertise with us today.
Steve Bliss: My pleasure, Brenda. It’s always important to raise awareness about the significance of estate planning.
