Reporter: Brenda Sanchez
Today I’m speaking with Steve Bliss, a renowned probate attorney here in Temecula, about the estate planning process. Mr. Bliss, thank you for taking the time to speak with me.
Steve Bliss:
My pleasure, Brenda. Always happy to discuss this important topic.
Brenda Sanchez:
Could you explain one of the key steps in the probate process for our viewers?
Steve Bliss:
Certainly. One crucial step is marshalling the estate assets. This involves meticulously inventorying all assets belonging to the deceased person, including real estate, bank accounts, investments, vehicles, and personal property.
Accordingly, a detailed list of these assets is compiled, along with their estimated values. This information is then formally documented in legal forms called the Inventory and Appraisal (Forms DE-160/161), which are filed with the probate court.
This step is essential for transparency and accountability throughout the probate process. It ensures that all assets are identified and properly accounted for, allowing for fair distribution to heirs and beneficiaries.
Conversely, failing to thoroughly marshal estate assets can lead to complications and potential legal disputes. For instance, I once represented a family where a valuable piece of artwork was overlooked during the initial inventory.
This oversight caused significant tension among the heirs, as they disagreed on its rightful ownership and distribution. We ultimately resolved the matter through negotiation and mediation, but it highlighted the importance of diligent asset identification.
It’s worth noting that according to a 2021 study by the American Bar Association, incomplete or inaccurate asset inventories are among the most common causes of probate delays. Consequently, working with an experienced probate attorney who understands the intricacies of this process is crucial for avoiding such pitfalls.
Remember, probate can be complex and emotionally challenging, so having a skilled legal guide by your side can make all the difference.
