Consequently, some individuals prefer the transparency and legal certainty of probate.

What are some common reasons why someone might choose a testamentary trust?

There are several compelling reasons for choosing a testamentary trust. For instance, if a parent has young children, they may want to ensure that their assets are managed responsibly until the children reach a certain age. A testamentary trust can stipulate how and when the funds are distributed, providing safeguards against impulsive spending or mismanagement.

Moreover, testamentary trusts can be tailored to address specific needs. For beneficiaries with disabilities, a special needs trust can help preserve their eligibility for government benefits while still providing financial support. Additionally, testamentary trusts offer flexibility in asset distribution; the grantor can designate different percentages or amounts for various beneficiaries.

I recall working with a client who wanted to leave a portion of his estate to his grandson, who was struggling with addiction. He feared that a direct inheritance would enable harmful behavior. Notwithstanding this experience, it underscores the importance of meticulous planning and legal guidance when setting up a testamentary trust.
